Supreme Court Rules Against Ban On Young Foreign Spouses Entering UK

Banning foreign spouses aged between 18 and 21 from entering the UK is not a lawful way of dealing with the problem of forced marriages, the Supreme Court has ruled.

By a 4-1 majority, the highest court in the land rejected an appeal by Home Secretary Theresa May against a Court of Appeal decision which outlawed the ban as "arbitrary and disruptive".

Wednesday's ruling upholding the appeal judges is a victory for two couples who had fallen victim to changes to the immigration rules that prevented non-European under 21s from obtaining visas to join their British partners in the UK.

Its a bit rich asking people to come to this country only once they have passed loads of tests and criteria only to turn around and let in anyone with the ability to say "i do" in their native language.

Yeah I can see the problem with trying to do that with people who are no longer minors.

Provided the marriage was legal and not a forced one, and the people involved where of legal age, the Supreme Court decision is correct.

Is not the problem that most Illegal and forced marriages, are never brought to the authorities notice, and having this law in place would certainly stop some very young people getting into these situations?
Secondly, if this was a "law", as in, on the books so to speak. Can a tribunal of judges change the law of the land simply by saying "it is not lawful"? Because i assume once a law is enacted, it is and must be lawful? Or am i sort of getting this all wrong?

It's a sound judgement by the Court, as it's a breach of human rights.
