A graduate has launched legal action against the government after she was allegedly "forced" to stack shelves in Poundland without pay.

Cait Reilly, a Birmingham University graduate, submitted a judicial review after she was apparently told by her local Job Centre she would lose her benefits if she did not comply. The 22-year-old's case was publicised last November, when The Guardian reported Reilly was working five hours a day for three weeks at the discount store in south Birmingham.

Reilly, who graduated from university with a BSc in geology, told the paper at the time she was "being used as free labour, especially in the run-up to Christmas". She had been volunteering at Birmingham Museum and Art Gallery when she was ordered to accept the placement at Poundland for two weeks, despite already having had experience in the retail sector.

She, along with others, was reportedly told she would not be eligible for her £53-a-week Jobseekers Allowance (JSA). Public Interest Lawyers, acting on behalf of Reilly, issued a landmark judicial review on Wednesday against the government.

Her lawyers are claiming she was made to carry out "forced labour", which is against the European Convention on Human Rights.

Solicitor Jim Duffy said: "This government has created - without parliamentary authority - a complex array of schemes that allow Job Centres to force people into futile, unpaid labour for weeks or months at a time.

"By doing so it worsens rather than alleviates the cycle of unemployment that is such a significant barrier to addressing the economic crisis."

A statement released by Poundland said its work experience was designed to help unemployed people find work in the retail sector.

"We work in partnership with JobCentre Plus and other government funded organisations to implement a comprehensive work placement programme designed to provide on-the-job training for those looking to retail as a career opportunity."

Reilly is asking the High Court to quash the controversial regulations detailed in the Jobseeker's Allowance (Employment Skills and Enterprise) Regulations 2011, which stipulate that the long-term unemployed can be required to undertake up to six months of unpaid work.

"I think it's a form of manual labour in that they're forcing people to do jobs that are in no way related to what they want to do and giving them no experience for their careers," she told the BBC.

A Department for Work and Pensions spokesperson said: "Our priority is to help people off benefits and into work. We are looking to help people get practical experience that will give them a better chance of getting into work.

"It is simply absurd to suggest that we should not be providing this support and effectively leaving people at home doing nothing."

The government are under increasing pressure to address the issue of unpaid work experience, particularly after a report released on Wednesday said graduates without this experience were "unlikely" to get jobs.

I'm probably going to be really unpopular now but here goes...
Why should this woman be allowed to be given thousands of pounds for nothing? Working in poundland may be beneath most of you who seem to think this woman has been paid NOTHING for working for a few weeks? Are you kidding me!? She has been paid at £53 per week for at least 6 months. To play with some pens? When I applied for JSA last year, I was volunteering for care work as I am trying to get into social care. Here was my response "I do apologise Miss White, as you are not available for 18 hours per week, you are not eligible for JSA". I have worked for 30 years full time putting money into the pot, after being made redundant I thought I would take it as an opportunity to change my career only to be told no. So I now work at Tesco in my spare time as a shelf stocker. I also volunteer. So why this woman was even on JSA I don't know. Get a job, if you really want experience you can volunteer and work in McDonalds in your spare time. Sorry I don't really see why she can spend more of our money suing the government that have housed her for so long and fed her.

Sorry I thought I would also add that people keep saying on this forum that their kids were 'exploited' with this same scheme... Tell your kids to get a job, KFC, Burger King, they're always hiring.

Sorry if it wasn't clear I was actively seeking employment when I applied to JSA, and was offered a job 2 days after being turned down.

I dont see anything wrong with this, you should not be to stuck up to get your hands dirty and get of your backside and get a job.If this young lady had shown promise she might have ended with a full time job with poundland and not scrounging from the state

16. The Government does not accept this position. The Mandatory Work Activity Scheme is targeted at those customers who have demonstrated that they require support to gain work related disciplines and re-engage with their search for work, as well as failing to voluntarily engage in the support that is offered by Jobcentre Plus. The Mandatory Work Activity Scheme is not a sanction, or a punishment, but has been developed in recognition that some customers require additional support.

18. Through the introduction of these regulations, we are not looking to amend the parameters of ‘actively seeking work’, as was suggested in the Committee’s report. A large number of the Welfare to Work programmes offered to customers are mandatory, and customers that have failed to attend receive sanctions. In all of these cases, the requirements on a customer are being increased with the explicit intention of improving their employment prospects. The Mandatory Work Activity Scheme is not intended to be any different.

20. The Committee indicated it was not persuaded that the Mandatory Work Activity Scheme would have a significant impact on the employment outcomes for people who are out of work.

9. The Department has been clear throughout that the Mandatory Work Activity Scheme will be delivered by contracted providers. It has outlined that providers will have responsibility for requiring customers to carry out specified activity, and that failure to complete this activity will be subject to a sanction imposed by Jobcentre Plus. In the form they were presented to you, the proposed Regulations did not allow the providers to operate in this way, and therefore the Government has inserted ‘Part 6’ of the Regulations, in order to provide this power.

12. However, the Government does not accept the Committee’s key recommendation that the introduction of this scheme should not continue. The Mandatory Work Activity Scheme is designed to have a positive impact on those who participate and this is the right approach to take to help those who need this type of experience and motivation to get them better equipped to find employment.

3. The intention is that the placement will last four weeks and will be aimed at helping the customer develop the labour-market discipline associated with employment such as attending on time and regularly, carrying out specific tasks and working under supervision.

4. Mandatory Work Activity will help customers who may have limited or no experience of employment, or have little or no understanding of the behaviours required to get and keep work. The Mandatory Work Activity Scheme will address this by helping customers discover for themselves the expectations of work; turning up on time and every day, following instructions, working in teams, and many other elements of employment.

One aspect of this that should be strongly supported, in my opinion, is the fact that here is a person who is not prepared to accept what the government has foisted upon her. I suspect she is being used by lawyers who are against new rules designed to get the long term unemployed off of benefits and into work. Some fit and healthy people living on benefits have no intention of working, they think the world owes them a living.

Cait Reilly had the get up and go to find a voluntary placement to improve her skills so should be applauded for that and not vilified. The thing that doesn't sit right with me though is the fact that she is suing the Government. All this negative press and backlash will not make her an attractive prospect to most potential employers. Is she just a pawn in her solicitors game to raise their profile?

I just hope the people who back the taxpayer funding parasitic lazy feckless businesses to exploit the bankers victims find themselves in the same position. Oh, they won't, because they are the voice of privilige and comfort. This is a national disgrace. If people are forced to work for a company they should be paid the minimum wage by that company. This is clearly a human rights breach, and I expect her to win in court.

This is quite laughable really. She IS being paid to work in Poundland - the JSA she is receiving from the government is the payment for the work done. If this person is totally incapable of getting a job in the 9 months she's essentially been leeching off the tax payers money then she deserves to be forced to do some work for the JSA. Either find work yourself or accept that they will make you work for your JSA now. The country has billions of £'s worth of debt courtesy of the Labour government we ALL have to chip in and accept some sacrifices until this debt gets paid off and then i'm sure Labour will get voted back in and spend it all again.

She wasn't being paid £1 per hour, if she received JSA for 6 months and had to work 25 hours a week for 3 weeks she was in fact paid £18.37 per hour volunteer work should be done in your own time, if you claim off the state, you agree to their t&c. If she was told to work for three measly weeks she

Please read the article- It is about work experience and introducing a work ethic. JSA is for people who are actively seeking employment! (Not playing with pens in a museum)

My daughter has a degree, is funding herself, with a careers loan, through a masters degree, and working part time in a cafe to feed herself, as well as blogging for several music sites to gain experience(this includes funding trips to London to interview musicians). She would love to walk in to her dream job, but isn't prepared to sit on her @rse and wait to come to her! Job seeker allowance is not a God given right and should be earned!

That's where you're wrong -she worked part time when she did her degree because I couldn't afford to keep her in uni, she worked full time in the university for four years before taking on the masters and in her free time worked for various charities and mentored a diabetic adolescent girl. She's packed a lot in to her young life. What has confidence and assertiveness got to do with the thread?

JSA is just as much an entitlement as tax allowances are, and believe you me my parents take full advantage of the latter. Those who refuse to take advantage off all the benefits society offers are fools, and will never become financially well off.

Pride doesn't pay the bills darling, and that's the only thing that matters.

Does that give her the right to use the taxpayers money to sue the government? I can think of far better things I'd like my contributions used for.

It's society's fault for breeding a number of lazy freeloading ingrates with no work ethic! If more were made to work for their JSA then perhaps they'd make more of an effort to find a job they would like to do.
