Disability Benefit Tests 'Must Be Fair'

Ministers were urged today to ensure eligibility tests for a new disability benefit are "accurate and fair" before they are rolled out nationally.

The Work and Pensions Select Committee said there were "high levels of anxiety" among claimants of Disability Living Allowance (DLA), which is to be replaced with the new Personal Independence Payment for those of working age.

The Treasury has projected 20% savings under the new system, to be introduced in 2013, but it was still unclear which claimants stand to lose their benefits, the committee said in a report today.

Committee chairwoman and Labour MP Dame Anne Begg said the new assessment must avoid the mistakes of that used for Employment and Support Allowance (ESA) from 2008, which had a "mechanistic, box-ticking approach"

"The Government's own estimates show that 500,000 fewer people will receive support by 2015-16 compared to the situation if DLA for working-age claimants had continued," she said.

"Announcing the change against a background of budget cuts, and the previous negative experience which many people have had with the Work Capability Assessment (WCA), has created high levels of anxiety amongst DLA recipients."

The committee said the tests should not be implemented nationally until a limited regional trial had proved successful.

"The Government needs to be certain that the new assessment procedure is accurate and fair before it is introduced," Dame Anne said.

"Otherwise, there is a risk that people with serious disabilities and health conditions will lose the money they rely on to meet the additional costs incurred as a result of their disability - costs such as maintaining wheelchairs, using specially adapted cars, or paying for help to ensure they can live independently."

Disability campaigners urged the Government to heed the MPs' report.

Richard Hawkes, chief executive of disability charity Scope said: "The Government wants to create a more targeted payment. But if it goes ahead with the proposed assessment there is no guarantee that support will go to the people that need it.

"Day-to-day life costs more if you're disabled. PIP should be a financial lifeline for disabled people, but if they get this wrong many more will be being pushed further into poverty."

Simon Shaw, parliamentary manager at the deafblind charity Sense, said: "We urge the Government to change the way it assesses people while there is still time.

"We specifically welcome the Committee's recommendation that the Government consider the effectiveness of face-to-face PIP assessments for people with impairments that are severe or unlikely to change, such as deafblind people, when there is sufficient written evidence from medical and social care professionals with knowledge of the person's disability."

Steve Winyard, head of policy and campaigns at RNIB, said the Government had "a lot of work to do" before the PIP - contained in the controversial Welfare Reform Bill which has been repeatedly defeated in the Lords - was introduced.

"Blind, partially sighted and other disabled people must not find themselves forced to go through lengthy, costly and stressful appeals processes to get a fair outcome," he said.

The Department for Work and Pensions said DLA was "outdated".

"Under the current system there are hundreds of millions of pounds of overpayments and underpayments and 70% of people get the benefit for life without systematic checks to see if their condition has changed," a spokeswoman said.

"We are replacing DLA with Personal Independence Payment and introducing a new face-to-face assessment and regular reviews to make sure people are getting the right levels of support.

"We have been working with disabled people and around 60 disability organisations from the start to get the assessment right, and have made significant changes as a direct result of the comments we have received - improving the assessment and making it fairer."

dla is for getting around ,You can claim the higher rate and still work ....... the thing is dla is being given to them who really dont need it .I know of some one who gets it ,then exchanges it for a new car ,So her son can ride round in it .............

Failed spinal surgery, balance problems, walking any distance is difficult with severe pain, arm and neck problem confirmed by medical specialist, 29 tablets each day, anything and everything checked and confirmed by medical authority. Yes I have a disabled car, but because of my health issues I'm unable to live a normal life, so the car is a major help without it my home becomes my prison. For the genuine people who have medical problems as confirmed by their health authorities, shame on this government for targeting the vulnerable people of our society.

Of course the testing will be fair and equitable...No one will pass and no one will be able to get benefits..........

Quick question is there any group in Britian this government has not targeted for cuts?

my wife who has suffered from clinical depression for 30 yrs ,and who would love to hold down a job,but is unable to ,because when the illness hits ,it hits her so hard that even with her medication ,there is no chance of her being able to perform in a work environment
the "examination" to decide if she was "fit" for work consisted of 2 nurses asking a couple of quick questions,then are you able to stand unaided,can you raise your arms higher than your shoulder,and lastly can you bend your knees.all of which she was obviously able to do ,BUT one question ,,,,,what on earth has that got to do with a MENTAL illness ??
and guess what 2 weeks later ,the letter arrived with the "very sorry to inform you"that the lower lever DLA has been stopped.we are going to appeal ,but don't in truth hold out to much hope .

same thing happened to me i had spine opersation got metal plates to hold it together cant bend cant sit for longer period of times have and am in pain al the time have to go to pain managment to learm to live with it i can dress my self it take a long time
u have a examination which i complained bout as the questions just made me crack it here goes
1 can you hold a milk carton for more than 20 secs
2 can you go out on your own with out getting lost
3 can you climb forthan two step with out help
4 can you use a computer and mouse

with that i was taken off EMA put on JSA the jobcentre sent me for a cleaning job in a four story office no lift i had to clean flour floors in 3 hours

i told emplyer i had bad back he didnt give me the job
went back to jobcentre and told i lost benifits cause i made my self unemplyed

so im now under the hospital for depression and see a strink

just dont no what the goverment is doing to us

I'm in a similar situation, was told I couldnt get DLA as apparently could walk just fine unaided, apparently this was witnessed by the 3 appeal people, funny how I was in a wheel chair as I couldn't walk unaided and the appeal center was up a hill! I also had 5 witnesses to prove this. I am being told I have to go back to work in April.

I know exactly how you feel. I am not in Disability but my doctor said that in my state I ought to be. I'm on Incapacity. I have very severe anxiety problems, along with depression and other mental illnesses which make me incapable to work. It angers me when people suggest laziness...I went to Uni for FIVE years to get a BA Hons 2:1 in French/Italian and then, despite severe panic attacks managed an MSc in Tourism. My plan was NOT to stay at home living on benefits. I have gotten worse through the years, including my own sortie outside which saw me trip in a pothole, ripping the ligaments in my left foot and severely bruising it (3 years ago and I'm still unable to walk properly, without pain too). I was actually told I hd no grounds for Incapacity benefit at one point because I could read a viewing chart ( I wear contacts) and because I could stand unaided etc. Thankfully I finally got my Incapacity Benefit back but I am house-ridden. My OAP parents have to work extra to keep me as I'm too scared to apply for Disability. YET junkies get money because they turn up looking flithy which apparently proves they have 'depression'.? One reason my IP was unallowed was because I was 'dressed properly'. I hate this system!!!!

There are a lot of Free Loaders in the system but having said that the government does not understand the concept of fair indeed any monies they would potentially save would only be squandered in other areas due to the financial incompetence that all governments seem to run

Yea it's got to be 'There having a laugh arnt they ??? Under the system now people with sore feet can get the higher rate of dla ...its simple if your in medical need ie have problems with very bad health then you have nothing to worrie about ,But if you claim Dla so your son or daughter can run round in a brand new car ,then the free ride is over .its got to stop ,p.s. Im in a wheel chair and have never claimed a penny and i have no intention of doing so ....

I know of several people claiming disability benefits and a free car every 3 years and yet a couple of them go out dancing on a Saturday night yet nobody checks up on them. Wonder why?????

here we go again slamming this goverment . there is a lot of monery ( taxpayers money ) going to scroungers who pretend to be an invalid.and these are the people who should be rooted out. there are people in this country who geuinely need help, but cannot get it because there are to many claiming benifits who should not be claiming
i.m a pensioner who has worked all his life never once claimed anything untill now ( BUS PASS ) when you see those on invalidity benerfit with brand new cars running around. changing them every three years it makes my blood boil. this is why genuine claiment cann't get what the deserve

I agree with you bluepip, because I have a car I have not applied for a free bus pass and I am in my late 70s, because more deserving people need it who have no transport at all.

Barb, in Canada we don't have a free seniors bus pass...I am 72 and don't drive anymore due to a stroke, but a bus pass would really help. Not a likely thing in Canada though, a bus pass for a senior is nearly a hundred bucks a month.

I am just a statistic. FORCED to hang up my quals and retire from a top teaching post at just 39, a workaholic fool, who eventually crashed with MS. Someone even` reported me last year and I had to attend an interview under caution..that was just after I had collapsed and taken my daily oramorph for spinal/nerve pain !....what were they thinking, that I was outdoing them in some way..that I was enjoying all the problems MS brings with it, whilst sitting watching Loose Women ?......I would love to go back teaching, and would give anything in the world to be able to walk without someone thinking I had had too much to drink, so I stay indoors and prevent the anguish...get the real scroungers back to bl**dy work........they don't know what the word pain means, nor do they understand real illness !! There needs to be a new DLA assessment asap~one that advocates 'fairness' yet discriminates 'greediness'. If an individual is incapacitated, whether mentally or physically, then they should be financially compensated...the 'real' disabled out there will understand what I am referring to quite clearly....I took my healthy life for granted but now forced to see the darker side of illness. It's not a pretty sight, it doesn't matter how many times nor how much of a brave face you try to put on to others, the truth will always shine through.
This current Government don't seem to give a '!'

Her we go again with the AOL goverment sponsered lets bash the disabled again. Start dishing out untrue facts so as the public start having a go again.Notice the article states !It is unclear who will lose benefits".Thats because the government havent said any particular group Just any and everybody they can get off disability benefits. They are also talking about those who cant get conned off are going to be forced to do unpaid work or lose the benefits. I thought that disability benefits was paid to those that are disabled and unable to work for a living.Yes weed out the scroungers who have back ache (who hasnt) or those whos doctors put them on the disability because there is little chance of getting work (Merthyr Tydfill for example) But then leave the genuine disabled alone they have enough problems dealing with the sort of hatred that is happening to them because of all the SH**E that the Government and AOL are broadcasting acrost this country. So much for a caring Goverment and "Were all in this together". BAL:LS thats BO**ocks and you know it.

There are quite a lot claim disability benefits and the government are trying to weedle them out not bash the disabled as you put it. These people are taking a genuine persons disability benefit andthese people do not need it. I wish people would report the people on disabled benefits who are not really entitled to it.

they are trying to bash the genuine disabled . i have medical records going back to 1983 showing how my condition is getting worse year on year , & i have had my money stopped just because i couldnt answer 2 questions the ATOS NURSE asked me , do you think that is fair
