Arizona Employers 'Could Fire Female Workers For Using Birth Control Pills' If HB 2625 Bill Is Passed

Birth Control Safety

A proposed law in Arizona could apparently allow employers the right to fire female workers for using birth control pills.

The Republican-backed HB 2625 bill would allow bosses to ask women whether they are using contraception and even demand provide proof they are using the pills for non-sexual reasons.

Employers would also have the option to deny women contraception coverage if they are morally or ethically opposed to it, ABC 2News reported.

The bill was drafted by female state legislator Debbie Lesko, who believes employers should not have to pay for insurance for contraceptives if it conflicts with their moral values.

She said: “I believe we live in America. We don't live in the Soviet Union.

"So, government should not be telling the organisations or mom and pop employers to do something against their moral beliefs...My whole legislation is about our First Amendment rights and freedom of religion. All my bill does is that an employer can opt out of the mandate if they have any religious objections."

The bill has already been passed in the house and a Senate Judiciary Committee and is now on its way to the full State Senate.

Arizona law currently allows religious employers to deny contraceptive coverage at their discretion. The new proposals would allow all businesses the same rights.

The American Civil Liberties Union has started a petition calling for the Arizona Senate to kill the bill.

It says: "This bill is about discrimination, plain and simple. It is about taking away a woman's access to basic health services. We know this bill isn't about religious freedom.

"Real religious freedom gives everyone the right to make personal decisions, including whether and when to use birth control, based on our own beliefs. It doesn't give the boss at a non-religious business the right to impose his or her beliefs."

The current law says: “A religious employer shall not discriminate against an employee who independently chooses to obtain insurance coverage or prescriptions for contraceptives from another source.”

But as azcentral points out, the provision has been removed from the HB 2625 bill, indicating that not only can employers opt out of providing contraception insurance, but they are also off the hook in terms of discriminating against workers who source their own birth control.

As blogger E J Montini asks: “Doesn’t that open up the possibility of discrimination or firing?”

The ACLU adds: "This bill takes away existing protections that prevent employers from firing or otherwise punishing employees for using contraception."

All this time we have been fighting a war against the Taliban in Afganistan and it turns out that they are in our own country. Is it only me or does anyone else find it ironic that we are fighting a war against conservative religious fundamentalist in one country while our own country is being taken over by them?

I spit out my drink thinking that the judge must have been 12. First of all, there is a separation of church and state, 2nd there is such thing as "The Privacy Act ", and thirdly, it is unlawful for any employer to ask quetions regarding marital status, sexuality, or religion. If I so choose to have sex with multiple partners, or my partner, I definately will not accept my employer telling me when and how I will be doing so. Perhaps providing employers with a full disclosure of personal sexploits will also become mandatory....HA ha ha, would you like pictures ? .... This judge needs to read the constitution, fully disclose her medical file, sexual orientation and habits to the public as she holds public office, and then be fired as an example and deported to Afghanistan.

Even if this bill were to pass, I don't think most bosses probably care whether or not an employee uses birth control. It would just open the door for some bully to harass female subordinates. There is no other point to this bill other than that it would allow for harassment.

Seems like only the most self-loathing type of female would put forward something like this. Is that state of AZ going to start checking members of the legislature to make sure they have a medical reason for using contraceptives?

Where in the law does it state that bosses may inquire about an employee's contraceptive use? How does inquiring make it legal to fire someone because of contraceptive use? I skimmed through, but I must have missed it.

Are you sure this article is about Arizona and not Afghanistan ?
If this bill goes through, Arizona will be a laughing stock and will have gone back to the stone age.

Workers are just that, and as long as they are efficient and able to carry out their tasks in a satisfactory manner their private lives should be up to them .
Of course there should be exceptions if they infringe the rights of other workers, for example if they become a sexual predator, or are violent to other staff members, but to demand they shouldn't take contraception is just plain dictatorship

Religions need to adapt and accommodate.
Jehovah's Witnesses blood transfusion confusion

Jehovahs Witnesses take blood products now in 2012.
They take all fractions of blood. This includes hemoglobin, albumin, clotting factors, cryosupernatant and cryopoor too, and many, many, others.
If one adds up all the blood fractions the JWs takes, it equals a whole unit of blood. Any, many of these fractions are made from thousands upon thousands of units of donated blood.
Jehovah’s Witnesses can take Bovine *cows blood* as long as it is euphemistically called synthetic Hemopure.
Jehovah's Witnesses now accept every fraction of blood except the membrane of the red blood cell. JWs now accept blood transfusions.
The fact that the JW blood issue is so unclear is downright dangerous in the emergency room.

DannyHaszard, there has been so much discussion about religious attitudes recently and I think you are absolutely right that they all have to adapt to the modern age.
As most religious doctrine originated so very long ago, and was pertinent to the ways of those times, they need a complete overhaul now. Everyone has to move with the times.
As for forcing women to have babies against their will, well, let the first MAN who gives birth and raises a child cast the first birth control pill!

If the woman working for an employer that enforces this ridiculious law, ends up pregnant, it will cost the employer's insurance a whole lot more in fees for the hospital birth of a baby than the cost of the pills!!!

Only in America, Land of the Free, yeah Bullshit.

Bootface51, what's the betting they will withdraw medical insurance for women workers? Looks like the US is going the same way as Afghanistan.

Exactly, in Russia they are very keen on contraception, in fact they have abortion on demand. A lot of women use abortion as a form of contraception, it's not unusual for young women to have several abortions.

that is simply appalling. what gives any employer the right to govern the bodies of his employees? and how is a woman expected to prove she is using the pill for non-contraceptive reasons, such as acne treatments or period-management or hormone boosting?. and how is it an employers business in the first place? this is basically taking rights away from women. a human right; her right to liberty. america is supposed to be the land of the free right? hmmm.... that works! not!

Employers have only one moral value: greed. If this sick law is implemented it should apply only to new employment contracts where both parties are fully aware of and have agrred to the ramificatiuons. However, if the employee makes no claim for contraception, the company has no right to ask what they do outside company time.
