A woman who placed the body of her newborn baby in her friend's garden to keep the birth a secret has walked free from court.

Fatima Ali, 26, wanted to conceal the out-of-wedlock birth from her family, friends and work colleagues in Bury, Greater Manchester.

The baby girl died within two hours of her cutting its umbilical cord in her bedroom, Bolton Crown Court heard. The judge told Ali that "had you acted appropriately her life could have been saved."

However then the shop manager left the baby's body in the house to go out with her family before she disposed of it on the way to work the following morning as she "sought to keep it her secret...forever".

Subsequently named Aliyah by police, meaning beautiful in Arabic, the baby was found wrapped in a shawl in the corner of a garden in Tinline Street, Bury, in September 2010.

Fatima Ali, of Alfred Street, pleaded guilty at an earlier hearing to endeavouring to conceal the birth of a child and cruelty to a person under 16.

The offence of cruelty related to the defendant not seeking prompt medical attention when the baby - named previously in court as Malaikah Dua Hussain -was born.

A post-mortem examination could not determine the cause of death.

Sentencing her to 26 weeks in jail, suspended for two years, Judge John Appleby said: "The tragedy that followed is of immense disaster for this child.

"There is no evidence that you ill-treated or assaulted the child and it is still a mystery perhaps as to the course of action you took following her birth.

"It is evident that you have suffered from psychological stress and trauma for a number of years.

"At the time of these offences your decision making and thought processes would have been compromised, according to the medical reports on you."

all this was down to cultural beef....nothing more nothing less....the girl was in a relationship with a different culture to hers which was deemed in her parents eyes as forbidden, she kept this relationship a secret from her family etc... the reason why she did that was, he was from a different cultural background and the guy being from a different background it was a big No NO from her parents to be involved with him they have been in a relationship since Oct 2007.. to cut the long story short she got pregnant and was too late to have abortion, and boyfriend unaware went abroad on business and she obviously panicked couldn't tell anyone of the pregnancy it is a big thing in the UK Asian community she was on her own with no one to support her as her partner was away on business for 6 months and she kept it hidden from him as well..the father found out about all this on Google out of all places and was abroad when he couldn't get hold of his girlfriend he was browsing and came across an article on the website. Thats the events that took place and drove it to all this am not saying she deserves prison, on the basis the evidence was given it was evident that she is suffering from mental behaviour which she is on a supervision order,

Yes this woman may have been raped which would be as bad as consenting sex as far as her family and ' Traditions ' go. But if this was the case she could have visited her GP for an abortion pill, or even bought it over the counter at most pharmacies.
Perhaps she has ' learning difficulties ' and had no idea where to turn to for help. The poor baby is far better off not having survived to be treated cruelly and or neglected by this womans family.
If she had been brave enough to tell them , they may well have disposed of the child in a way that nobody would ever have known. She has escaped jail time but I wonder just what her family will do with her now. THEY have lost face and will no doubt abandon her just as she believed she had to abandon the baby. Very sad for the poor baby, I just hope that she didn't suffer before she died. Having lived for about 2 hours the baby obviously drew breath, which means that her death was murder . Murder is after all murder and even if someone is deemed to be suffering from previous trauma, there SHOULD be a punishment.

It didn't say in the story how, why, who, how did they know and found the baby? So unless the mother told someone or a dog dug up the body how was it recovered?
O and John's comment where did they find the judge? Where do they find 99.9% of judges?

It also omitted to give the childs cause of death. Did the baby die because the mother cut the umbilical cord and the child bled to death? Far too many questions and probabilities so I would say it IS complicated

I get the impression there is much more to this story than we have been told....the woman may have been raped? Or it could have been a case of if her family found out she would have been killed? She may have been mentally and physicially abused for many years previous to this event? Either way it appears 'she' had a reason to do this act.....what confuses me is how no one realised she was pregnant in the first place! But regardless of the story, I dont believe she did this out of sheer cruelness or brutality. Yes she did a very wrong thing and could have gone about things a very different way....but this doesnt seem like a black and white case of murder.

Im in no way justifying what happened....I think its horrific...Im just saying this is more than just a case of cold bloody ruthless murder, otherwise the judge wouldnt have been so lenient. There is never a good excuse to kill a child....but we dont know any of the fact relating to the case, so it is impossible to label this woman.

Its unbelievable when family honour and reputation costs the life of a child she wasn't thinking of family honour at its inception, unless she was raped but in their religion that's still her fault.
But isn't cutting an umbilical cord and going out with her family leaving the child cruelty in itself ?
also very cold and calculating. This act should haunt her for the rest of her days. A life needlessly ended before it began for so called honour and reputation.

A post-mortem examination could not determine the cause of death . this statement is from above , i can tell you why this baby died , because it was born to a selfish person that put herself before the life of her baby , this is only just short of murder thats why this woman should be in jail for a very long time , she hid this baby because she did not want people to look down on her , proving she was thinking of herself and she was not mad . but before you start i am not bothered what colour this woman is or where she comes form , to me she is a woman .

Would they going to allow this mental women to keep baby in future or not? She already have harm her child regadless of what so this case should not be different then this. If someone else child have small brush, that child is takan and every other been born by her so from ow on she could spare life of other children. I hope
