A schoolboy was marched off a bus and handed over to police after forgetting his travelcard as he was dressed in a Red Nose Day outfit for a fundraiser.

Marcus Fadina was handed an £80 fine when he failed to produce his Zip Oyster card, which allows him to travel for free. The 11-year-old, from Dagenham in Essex, was reduced to tears during the distressing incident but Transport for London (TfL) are refusing to retract the penalty.

"He got scared, he thought they were going to arrest him," Marcus' mother Marissa told a local paper.

The pupil, who attends St Margaret's CoE Primary, usually keeps his buss pass with his school uniform but was wearing fancy dress as part of a charity fundraiser for Red Nose Day.

Marissa has since lodged two appeals to TfL and is still awaiting the outcome.

A TfL spokesperson said: "Young people are only permitted to travel for free if they are in possession of a valid Zip Oyster photocard. Otherwise, they must pay the correct fare.

"A bus driver may issue a vulnerable or distressed passenger with an unpaid fare notice which will permit them to travel and pay later within five days."

The spokesperson added the Independent Appeals Service rejected the first stage appeal as Marcus was not holding any type of valid ticket for travel.

UPDATE: A TfL spokesperson said: “Clearly it is vital that every passenger with a discounted or Zip Oystercard ensures that they are carrying it when they travel on our services. However on the basis of the information supplied to us in this particular case we have decided to uphold the passenger’s appeal.”

Why did he think he could travel on a bus without the Zip Oyster. It appears from the article that the boy did not explain to the driver who might have let him travel. I've seen kids run pass the driver not showing their card which has caused the bus to be delayed as the driver will stop the bus.

There's more to this than meets the eye.

Boris should step in and knock some heads together at TfL. They need to get a sense of proportion and some empathy. how would they like their own child to be treated like this? The fact that even when the circumstances of the case have become public there has still not been a retraction and apology is outrageous. Someone senior is responsible, and they should be sacked.

Poor little lad! OK, I hear what people say about trying to 'defraud a system', but for heavens sake have we all lost our ability to use common sense?

Many years ago - on a short bus ride to her school - my daughter forgot her pass card. She was 12 and when asked for her pass by the conductor realised that she had left it, along with her wallet/purse, when she'd repacked her bag. It was on the kitchen table.

Close to tears, she explained this to the conductor and, as she had no money either to pay the fare, the conductor took her name and address and she carried on with her journey to school. We sent a letter, enclosing a Postal Order the following day and nothing more happened.

Mind you that was during a time when most people were both more tolerant any friendly to one another.

To be fair to London Transport they have a huge problem with people defrauding them by travelling without tickets - even Cherie Blair the wife of the former Prime Minister was caught stealing from them by travelling without paying .

Clearly this lad would be a lot more honest than her and not being a lawyer would not appreciate that traveling without first purchasing a ticket is theft - Mrs Blair seems to have missed that law lecture during her student days

Ridiculous, devoid of common sense. Everyone makes mistakes like this sometimes. I am disgusted that the police seems to be acting as unpaid debt collectors for bus and rail companies - oh and oil companies too, as you will find out if the cashier under charges you and you don't notice - you will receive a visit from the boys in blue within 24hrs! I did, they and the chief constable got a mighty flea in their ear and I got my fuel charge cancelled! It pays to fight these injustices!

If he was dressed in a Red Nose Day outfit and maybe wearing a red nose he would not have looked like his photo on the card anyway.

The kid should have paid or got off. We need to know if he got on the bus knowing he had forgotten his pass.
I do hope the fine is canceled, but parents, stop getting your photos in the article. It does no one any good.

OUTRAGEOUS.. how can grown adults treat a child heading off to participate in fundraising event for charity be treated in such a manner - it's absolutely disgraceful. Have any of the people in charge at TFL got any COMMON SENSE !!
Not only should TFL retract the penalty they should compensate him/his family for the distress. How shocking!!!

No one it seems is capable nowadays of using any sort of common sense,
distressing a little lad because he forgot his card.
Yet this country must be spending hundreds of thousands of pounds in legal aid so as That ''Qatada'' chap can try to wriggle his way out of deportation
and it seems the law is on his side.
I sometimes feel ashamed of this country and the lack of pure common sense it makes me so angry.

I am a senior citizen. Please let common sense prevail here. This is a child and the explanation as to why he did not have his pass is totally plausible. Either he had been at school all day or he was returning from school. Too many children these days do not attend school. Evidently he had entered enthusiastically into a charity event to raise funds for those less fortunate than himself. Sounds a good lad to me!! I suggest that the bus company in question responds with emotional intelligence to the appeal; rescinds the fine; and in a spirit of good will gives a donation to the charity supported by this young child as a way of saying: 'on reflection we have got this wrong'. It is not soft to say sorry!

He is obviously a child going to school, what did they think he was off to work sweeping chimneys? Honestly the poor boy has encountered a jobsworth, who must have rowed with their spouse the night before. Hopefully someone at TfL will see some sense.

I hope this mother has enough friends in her community to arrange a protest, this is unreal £80 fine for forgetting a bus pass wth as gone wrong, and if they did man handle the child get him done, fight fire with fire.
