Baby Jayden died from rickets

A young couple cleared of murdering their baby son, when he actually had severe rickets have called for an inquiry into two hospitals responsible for his care.

Rohan Wray, 22, and Chana Al-Alas, 19, of London, were accused of killing four-month-old Jayden, who suffered a fractured skull and died of brain damage in 2009.

However it was only after the death that doctors discovered the youngster was suffering from severe rickets, a disease caused by vitamin-D deficiency that causes bones to become soft.

The couple, of Islington, north London said that the Great Ormond Street and University College hospitals should have diagnosed the problem earlier and shouldn't have blamed them for their son's death.

They told BBC Radio 4's Today programme they believed Jayden would still be alive had his condition been correctly diagnosed.
Mr Wray, 22, said he was asked by staff at University College Hospital how his baby's injuries had occurred.

"I said apart from him rolling over in his cot and hitting his head on the side of the bars I can't think of any other explanation because we haven't dropped him, nothing's dropped on him," he said.

"The look from them was that simply they didn't believe my explanation."

Ms Al-Alas, 19, said they were prevented from seeing Jayden after he was transferred to Great Ormond Street and later learnt the hospital had spent four hours getting his injuries scanned.

Describing the past two years as "horrible", Mr Wray added: "I really feel that they didn't really know what they were doing and they just pre-judged us way too early.

"You should actually be treated as innocent until proven guilty and not guilty until proven innocent."

Last December the couple walked free from the Old Bailey after being cleared of killing Jayden.

But they later faced allegations over the child's death in the civil family courts from the local authority in whose care their daughter Jayda had been since her birth in October 2010, at a time her parents had been charged with the murder of her brother.

The case brought by the London Borough of Islington was that Jayden "died as a result of inflicted trauma caused to him whilst in the care of the parents".

It was further alleged that he suffered "a number of fractures that, despite having rickets, were caused by non-accidental injury".

However, in a judgment made public yesterday, Mrs Justice Theis, sitting at the High Court's Family Division in London, ruled that the allegations made against them had not been proved.

Care proceedings in relation to Jayda were dismissed and she was returned to live with her parents.

During the criminal trial the Old Bailey heard that Jayden died from brain damage and swelling but nearly 60 medical, professional and expert witnesses were unable to agree on the cause.

The prosecution said the brain damage could only have been caused by the trauma of Jayden having been shaken or his head having been hit against something.

But the defence said it was only after the baby's death that it was discovered he had rickets caused by a vitamin D deficiency. This would have caused him to have weak bones, including a weak skull, and could have caused a series of fractures.

In her ruling, Mrs Justice Theis said it was accepted that Jayden had congenital rickets and announced that she could not be satisfied "on the balance of probabilities" that any of the fractures or the "traumatised fissure" were "as a result of inflicted deliberate harm caused to Jayden by either of these parents".

Jenny Wiltshire, Ms Al-Alas's solicitor, told BBC Breakfast: "Well I hope that lessons will be learned and hospitals will try to be a bit more open-minded and investigate every single possibility before pointing the finger."

It seems to me that the NHS should blood test mothers and babies for vitamin D deficiency at key stages in pregnancy and infancy - especially those with darker skin.

From what I heard the Vitamin D deficiency was passed on to Jayden at birth through his mother's Vitamin D deficiency. My heart goes out to these parents who also had to suffer having their second child taken from them at birth and put into care for so long. Justice needs to be seen to be done.

It is very sad and the poor parents must have been through hell, I hope the get compensation and are able to put this ordeal behind them.

I thought the child died of brain damage, not rickets. It is hard in this day and age to accept a child suffering from them. Had the child not been taken out each day. Twenty minutes of daylight give a person enough vitamin D for the day. There are also child clinics that advise parents on what a child needs to be fit and healthy, although we should all know. I feel there is a bit of passing the buck.

craggy youve hit the nail on the head, why did he have rickets in the first place,surely that's got to be neglect in the first place, and it seems to me to have been a conveniant excuse to steer away from the more serious charge,lets hope not !!

Sorry to disappoint you two and your need to inflict guilt onto this innocent young couple but people with darker skin produce less vitamin D than those with lighter skin, for the same amount of sunlight and more especially in northern temperate zones, such as the UK.

When are we going to go back to training doctors and nurses properly with a wide experience and knowledge of all disease instead of being so bureaucratic and specialised.The emphasis is on administration and how to justify poor standards of care instead of supplying well trained experienced staff with basic skills. They have down graded our standards in this country to the point where only money and how many scapegoats they can find to excuse bad management and greed. This young couple are the casualties of bad training and carers looking over their shoulder because they and the general public are getting to the stage where justice is something they are afraid no longer exists, except for people who can pay. Justice is something that should serve us all not just those who have wealth and power, and yes you used to be inocent until proven guilty but if that doesn't fit ,these days you meet the statistics. I am a nurse of some 35 years and still working, with the phillosophy that we as a proffession should be there to give impartial care and sympathy whilst alleviating pain and suffering, and yes I leave the paperwork until last exactly where it should be, care should always come first administered with compassion and understanding whilst giving the best care available. Not form filling and suspicion accompanied with fear and a feeling of helplessness for the inocent and triumph for the guilty.

Im glad this miscarriage of justice has been made aware of, I babysit for a family and the youngest child constantly gests into mischief- also hurting herself no matter how careful you are! I was called to the police to give a statement as she was playing with her sister and bumped her head and the hospital called social services. I knew what sort of child she was so I knew her parents had nothing to do with it but the way the police were asking I felt so intimidated! I know it has to be done after baby p but its wrong that their other baby was taken from them when they had yet to be convicted of anything.

As an adult I have far too much calcium in my blood and very little vitamin D. I am allergic to the sun which causes me to have rashes & blisters. Vit D can and is usually obtained from sunlight and helps your body absorb the calcium into the bones. I have to take a very high supplement of Vit D each day. Vit D can also be obtained from leafy green vegetables. However this was a very young baby and probably only taking milk, which does contain calcium for healthy bones. But without the Vit D this can not be absorbed properly. I would have thought that if the hospital doctors had been doing their job properly they would have checked the baby 's blood and this mis carriage of justice on the parents could have been avoided.

And, what are you inferring? I listened to this gentleman, his wife and their solicitor being interviewed this morning and it was quite obvious they have gone through hell, the victims of an incompetent doctor and medical staff, over zealous social services and misguided police. Its obvious you know nothing about rickets, an ailment more commonly found in children and causing soft bones leading often to fractures and deformity. The courts cleared them completely and even then they were not allowed to have their other child returned to them until after a family court had gone through the whole process again clearing their name. The father was totally innocent of any crime but was incarcerated and had his name blacked, yet the hospital and social services convinced the family court not to release the names of the incompetents who had wrongly accused him and his wife. His wife had her later child taken away from her straight after birth without the chance to even hold the baby. This is a terrible crime committed against this couple, those responsible should face criminal charges.

The problem is the hysteria caused by the 'safeguarding children' programme run by the officials is seriously p.r.e.d.j.u.d.i.c.e.d. If you have children and live at the wrong address (not considered the des res area) you are considered a child offender. You can't even take your child into the hospital with a minor injury without being considered a child offender. I am serious. They have forgotten, all people are innocent until proven guilty, not the other way around.

I fully sympathise with this young couple. I myself went through a very similar incident, when my son was a baby. My fathers son and I were accused of shaken baby syndrome and where police interviewed and there was an inquest about our sons welfare. To cut a long story short, they had found out that the problem with our son was that because of the trauma at the birth had cause pressure to build up in my sons head and brain causing retinal bleeding which is very similar symptoms as shaken baby syndrome. I knew from fact that if my sons father and I were an older couple we would of not been treated in such a disgraceful way. RIP little one, and I hope these two can continue with their lives without worry xxxxx

Trouble is the authorities cannot win. Everyone judged them when Baby P was killed and now everyone is moaning that they came down too heavy handed. Surely it's better to be safe than sorry.

Actually it was because the doctor and team dealing with the child, misdiagnosed the cause of the babies injuries and did not properly check for Rickets and vitamin D deficiency, The misdiagnosis was compounded by the radiologist who did not study the child's x-rays up to the standard one would expect and the social services who forgot their job and duty is to act in the interests of not only the child, but the whole family. They should have questioned the medical staff but were too ready to accept the initial medical diagnosis and focused completely on the child and not the whole family. I agree sometimes the authorities can't win whatever they do, but it's not the case with this couple. The whole established system failed through sloppy and lazy attention to detail and the almost criminal abuse of a couples rights as normal parents. I hope they get a hefty compensation award and those responsible are held to account so it won't happen again but of course we all know it will.

You think compensation is the answer. Surely better practises are the answer. That is the trouble with this country now, people are only interested in getting money. Money won't bring their little baby back.

EastLondon you are being racial. There is a surge in rickets. When it is not congenital it is generally because all of us, especially the paler skinned folks, are keeping our kids out of the sun to protect them from its harmful rays. Apart from that, they spend much more time indoors on their computers and out of the way of dangers as diverse as heavy traffic and sex offenders.

The part of this story that got me most angry the cruelty inflicted on them when their daughter was born. Her father wasn't even allowed in the room and her mother wasn't allowed to hold her once. With a roomful of medics the child was hardly in any danger. They weren't even convicted criminals. That's just downright nasty

In hindsight its easy but if they had granted access and something happened you lot would be forming a lynch party for the poor idiot that gave access

Yes well you little Englanders are what makes this country so great (not), aren't you? Just use a little imagination. Accused of murder or not, these people were still the parents of the child being born, and anyone attending the mother would have been capable of making a judgement call in relation to their state of mind, not to mention arrangements to secure the baby. No. That's the same kind of bloody mindedness that has landed us all with 10 years of Abu Qatada. No one wants to do the right thing because it's more than their job's worth.
