Halle Berry has lost her legal battle to move her daughter Nahla permanently to France.

The actress wanted the four-year-old girl to live with her in Paris on a full time basis, but a judge has ruled in favour of her former partner Gabriel Aubrey to keep the little girl in the United States.

Halle had argued that life in California and the constant publicity and press interest she endured made it a dangerous place to bring Nahla up, and, according to TMZ.com that Paris would be a 'better lifestyle choice'.

Halle, 46, and French-Canadian model Gabriel split in 2010, having dated since 2005. They have since endured a lengthy legal battle over the custody and access arrangements for their little girl.

The Monster's Ball star had reportedly been planning to set up home in the French capital with her new fiance (and Kylie Minogue's ex) Olivier Martinez, to whom she became engaged in March.

She had previously pulled out of movie roles in order to concentrate on the custody litigation.
