Bailiff Behaviour Targeted By Ministry Of Justice

Bailiffs Evict

The government is revising guidelines on the conduct of bailiffs to stop "unscrupulous" practices in the industry.

Announcing the change, justice minister Jonathan Djanogly said: "Bailiffs are an important part of the justice system so the few unscrupulous bailiffs must be stopped from putting people in harm’s way or taking advantage of the vulnerable."

The government has updated the 'national standards' - a set of guidelines for bailiffs - in an attempt to prevent them from misrepresenting their powers, using unlawful force to get into someone's home, and to recommend they withdraw from someone's home when only a child is present.

But Labour MP Austin Mitchell, whose daughter was affected by intimidating debt collectors, told Huffington Post UK the changes weren't tough enough: “The government must toughen up the voluntary code for a legally binding regime and have it backed by an independent regulator”.

Gillian Guy, Chief Executive at Citizens Advice Bureau said: “These National Standards have been around for years. Justice Minister, Jonathan Djanogly is right to renew efforts to bring bad practice among bailiffs to account. But the new rules won’t offer any more protection unless there’s an independent regulator with the power to control bailiff conduct and ensure fairness for people in financial difficulties."

As he announced the standards, Djanogly outlined the proposals to create a new legally-binding regulatory regime for bailiffs. The regime aims to limit what fees bailiffs can charge for debts they collect for councils, debts and businesses - as well as clarify what goods bailiffs cannot confiscate from properties and what time they can enter properties. The Ministry of Justice said that the Djanogly's proposals will consulted on by the House of Commons in Spring - with a view of turning them into law.

Labour Shadow Justice Minister Rob Flello MPsaid: "We welcome attempts to bring greater clarity to the fragmented and confusing rules that regulate the operation of bailiffs. However, this announcement is much delayed and the government's proposals appear half-hearted in their desire to tackle rogue bailiffs."

Changing The World One Step At A Time

This is an act that should be repealed and given a complete overhaul given to how this is applied in today`s cash strapped world.
From a young age we are taught by successive governments that to keep the economy growing we need to buy goods and services, even if this means borrowing money on credit arrangements. As from our first agreement we are all on a downward spiral of indebtedness,so more than others.
As peoples incomes, jobs and livelihood are put at risk anyone can end up with the not being able to repay their debt`s and anyone having been in debt will know when you lend your lender is your friend, but when in debt no one want`s to know you.
Then one day a bailiff comes calling and once, that`s right just once you let them over the threshold they can come back anytime and gain entrance by fair means and in most cases foul.

So it is time for a real overhaul.

The Laws in this country were drawn up Centuries ago by half whits! The House of Horrors are run by degenerates that have no idea about Fair Laws etc. They are Pompous Loonies that don't know how to set up a system that protects the Poor People and also a Law that prevents the Rich from bullying the less fortunate into submission. Each day we hear people taking their lives through hardship, more often than not is not their faults they are in difficulty. What we need are High Fliers that know firsthand what it’s like to in poverty to create laws that protect the inner sent people. This is 2012 not the Dark Ages! Time to Protect British People and NOT the FILTHY RICH FAT CATS that prosper on the misfortunes of Failed Businesses, Mortgage Debts, Bank Debts, HP and Loan Sharks etc! BNP, Britain First and UKIP would all put an end to the CRAP! It’s up to you to vote the Main 3 Out. Vote for anything other than the Main 3. We need to get out of the EU and have the freedom to create and keep our new Laws. We need to drive Immigration out and also repatriate all Immigrants and their families including their children that landed here 30 Years ago. Multiculturalism hasn’t worked and never will work. An end to PC and the laws that protect the indigenous people will be drawn up too!

I'm surprised an MP who is paid £65,000 per year would let his own daughter get into finacial difficulties that resulted in the Bailiffs hammering at her door.

The article doesn't give any information why his daughter was 'affected by intimidating debt collectors', so we can know little of the circumstances.

there giving bailiffs who don;t follow the guidelines more guidelines, makes sense to me.

Easy solution, pay your bills!!! SIMPLES ! Even if you do end up in circumstances that mean you get a court summons , go to court , dont ignore it , they are actually quite good if you are genuinely struggling but trying to pay. All bailiffs that are not sent by a county court have no right to take anything out of your house..What we need is education for vulnerable people to know their rights..

Bailiffs they cost a lot of money ,they cant get you your money back ,but the court makes a fortune out of the system with its over inflated costs and penaulties ,its just a money making machine for the government .

I know two blokes that work for Bailiffs and they think they are James Bond, laughing all the time at other peoples exspence, I class them in the same groupe as trafic wardens and clampers, either bullys or have been bullied when young,
