Richard O'Dwyer, Student Accused Of Copyright, Can Be Extradited To The US

A student vows to fight his extradition to the United States to face copyright infringement allegations.

Richard O'Dwyer is accused of operating a website that offered free downloading and streaming of thousands of copyright films and television programmes without permission from copyright holders.

District Judge Quentin Purdy ruled on Friday at Westminster Magistrates' Court the 23-year-old will have to travel to America to face the accusations.

The Sheffield Hallam University undergraduate earned money through hosting advertisements on the TVShack website, allegedly receiving more than 230,000 US dollars (around £147,000) in advertising revenue since January 2008, according to the US authorities.

His lawyer, Ben Cooper, argued that the site did not store any copyright material but merely pointed users to other sites where they could download films and TV shows.

He said the website linked to other sites in the same way as Google and Yahoo operate, and people were not able to view a film from TVShack directly.

Mr Cooper added that his client would be the first British citizen to be extradited for such an offence and he would effectively become a "guinea pig" for copyright law in the US.

John Jones, for the US authorities, said the victims of the alleged offences included the film studios. He said that the website highlighted the savings that could be made in cinema tickets in the US.

Standing outside the court, O'Dwyer said he was "very disappointed" but he "had faith in the court they had made the right decision".

But O'Dwyer's mother Julie said she was "angry" and "disappointed" with the government for signing up to the extradition treaty. O'Dwyer does have the right to appeal to the High Court against the decision.

If is not a crime in the UK and he was not o US soil, then i don't think he should be exradited. if he robbed somebody in new york then of course. Regardless, he just being used to scare others.

If the American jury thinks O'Dwyer's likely sentence is excessive, it can acquit him regardless of the "law" and the facts, and the acquittal is binding. It's called "jury nullification". Spread the word!

This is soooooo wrong!!!! If a British White Guy can be deported for silly Copy Right Laws then why the hell can't we deport Immigrants that breach the Asylum rules or the ones that are here illegally?? We have so many foreign people that commit Murder, Rape, Kidnap, Scam, Rob,Benefit Cheat, Drive with no license or no insurance and take British Jobs from British people, why can't these people be deported???? Just goes to show our laws protect the none indigenous people!!!! Time to vote BNP, Britain First and UKIP or there will no longer be any laws that are supposed to protect the British People!!! PC, Civil Liberties, The EU, Court of Human Wrongs and the scourge of the Main 3 over the past 50 years have almost killed this country and the pride of the British people too!! Just to clarify, this kid never actually hosted any content on his own server he simply linked to it, go type "watch {movie here}" into Google...whats that? A link? Strange that a website containing links to illegal content but brings money into the US isn't under investigation, isn't it?

If it is a crime in the UK he should be tried here. If it is not a crime here why is he being extradited?
See the following from the newspapers about a request for the Duchess of Yorks extradition to Turkey and the Home Offices reply..
"Britain has an extradition deal with Turkey under the 1957 Council of Europe Convention on Extradition. However, the Home Office has said that it will not be providing assistance to the Turkish authorities because the Duchess’s actions in exposing poor conditions at the orphanage did not constitute a crime in the UK."

Amazing, US servicemen can kill and maim UK troops by their incompetence and get away with it with the lame excuse of ' fog of war '. And now we have extradition of our nationals to the US for so called internet security and financial crimes commited in the UK ?. It seems the past policies followed by Thatcher and Blair are now coming to light with the authority the US seems to have in the UK.

This is really appalling. O'Dwyer committed all the acts in the UK. They were not criminal here. Now the US seeks to enforce it's criminal laws on a UK citizen o has never been physically in the US. The action of the UK lapdogs has reduced UK's sovereignty to something which is subservient to the US. The US, no doubt, argue that as O'Dwyer's actions caused US criminal law to be broken he can be prosecuted by the US . And if that is the case anything which is legal in the UK but which breaches US criminal law and has a effect in the US may be subject to extradition proceedings. So if a UK citizen does something in the UK to a US citizen which, while legal here, is criminal there such action may be prosecuted in the US. This is madness. O'Dwyer should not be extradited to the US and the people who made this outrageous decision be fired: they are a serious threat to all our freedoms. If O'Dwyer has to fight this I hope that he does not stop until he gets a decision, if necessary, from the European Court of Human Rights.

Only if the UK Government says so. Under International Law nothing like this is allowable.
