The Democratic Alliance is taking on President Jacob Zuma in the North Gauteng High Court in Pretoria on Tuesday to battle it out on whether Zuma can legally delay establishing a commission of inquiry into state capture.

The DA says Zuma cannot ignore former public protector Thuli Madonsela's recommendation in her State of Capture report, published at the end of 2016, and must establish the inquiry without any further delay.

In December 2016, Zuma asked the High Court in Pretoria to set aside Madonsela's recommendations which included stressing that the judicial commission of inquiry should be presided over by a judge selected by Chief Justice Mogoeng Mogoeng. The president wants to appoint the judge himself.
