The victims had hoped for a better life in Britain when they agreed to pay up to £13,000 a head for a “VIP” smuggling service.
The 40-year-old admitted the manslaughter of 39 migrants who were found dead in a container in Essex last October.
39 Vietnamese people died in the trailer found in Grays in October.
The lorry driver is alleged to be part of a global smuggling ring.
Christopher Kennedy will appear in court on Monday morning.
Essex Police have confirmed they are working with Vietnamese authorities, however are not yet able to confirm the victims' nationality.
